COLLABORATIVE LAW

What is Collaborative Law?

Collaborative law is an alternative approach to resolving legal disputes outside of traditional courtroom litigation. It involves a cooperative and respectful process where parties work together, along with their respective lawyers and sometimes other professionals, to find mutually agreeable solutions.

In Collaborative Practice, each party has their own lawyer who is their advocate and supports them through the negotiations.

Since collaborative lawyers are trained in both Collaborative Practice and mediation, the lawyers use these skills to assist the parties in negotiations without being confrontational. The negotiations are respectful, supportive, considerate and constructive. The Collaborative Practice model also has the option of clients retaining a financial specialist, and/or mental health professionals, including child specialists, depending upon parties' particular needs.

IS COLLABORATIVE LAW FOR YOU?

Collaborative law can be an excellent option for individuals and families seeking a more respectful, cooperative, and solution-oriented approach to resolving their legal issues. Here's who collaborative law could be good for:

  • Couples Seeking an Amicable Divorce: If you and your spouse value maintaining a positive relationship, especially when children are involved, collaborative law provides a supportive environment for open communication, problem-solving, and reaching a fair settlement. It encourages cooperation rather than adversarial proceedings.

  • Co-Parents Looking to Foster Effective Communication: Collaborative law recognizes that ongoing co-parenting is essential for the well-being of children. By engaging in a collaborative process, you can work with professionals trained in family dynamics to develop effective co-parenting strategies, address concerns, and create a parenting plan that focuses on your children's best interests.

  • Individuals Prioritizing Privacy and Confidentiality: Unlike courtroom proceedings, collaborative law offers a private and confidential environment where you can openly discuss sensitive issues without the fear of public exposure. This confidentiality fosters a safe space for honest and open communication, encouraging parties to find creative and mutually agreeable solutions.

  • Those Seeking Empowerment and Control: Collaborative law empowers individuals by allowing them to actively participate in the decision-making process. You can work with a team of collaborative professionals, including lawyers, financial experts, and mental health professionals, to gain a deeper understanding of the legal, financial, and emotional aspects of your case. By being actively involved, you can shape the outcome and have a sense of ownership in the resolution.

  • Individuals Seeking Cost-Effective and Efficient Solutions: Collaborative law can often be a more cost-effective and time-efficient alternative to traditional litigation. By avoiding lengthy court proceedings, you can save on legal fees, reduce stress, and expedite the resolution of your family law matters.

Although Collaborative Practice has a high success rate (international statistics indicate about 90%), not everyone that begins negotiating in the collaborative process is successful in reaching an agreement in the process.
